These Terms of Service (“Terms”) govern your access to and use of the website meetfourleaf.com (the “Site”) operated by Tones Digital LLC (DBA FourLeaf) (referred to as “FourLeaf,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree with any part of these Terms, please do not use the Site.

1. Eligibility & Accepting Terms

You must be at least 18 years old to access or purchase from the Site. By using the Site, you confirm that you have the legal capacity to enter into these Terms and that you will comply with them at all times. If you are accessing the Site on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

2. License & Permitted Use

Tones Digital LLC (DBA FourLeaf) grants you a limited, non-exclusive, revocable, non-transferable license to use the Site solely for personal, non-commercial purposes, subject to your compliance with these Terms. You may not:

  • Sell, reproduce, distribute, or exploit any part of the Site for commercial purposes;

  • Create derivative works, reverse engineer, decompile, or attempt to extract the source code of the Site;

  • Use any automated system (bots, scrapers, or similar) to access the Site without our prior written consent;

  • Use the Site to build any product or service that competes with FourLeaf;

  • Remove, obscure, or alter any proprietary rights notices.

3. Intellectual Property

All content on the Site—including text, graphics, images, video, software, product formulations, trademarks, and logos (collectively, the “Content”)—is owned by Tones Digital LLC (DBA FourLeaf) or its licensors and is protected by U.S. and international intellectual property laws. Nothing in these Terms grants you any ownership interest or license in the Content except the limited right to use the Site as expressly permitted above.

4. Product Information & Orders

We aim to provide accurate product descriptions, images, and pricing, but we do not warrant that all product information is complete, current, or error-free. In the event of a pricing or listing error, we reserve the right to cancel or refuse any order, whether or not the order has been confirmed.

  • We reserve the right to limit the quantity of items purchased per person, per household, or per order.

  • Order acceptance is conditional on payment authorization, address verification, and product availability.

  • Prices, promotions, and product availability are subject to change without notice.

5. Health, Cosmetic & Safety Disclaimer

FourLeaf products are cosmetic products intended for external use only and are not intended to diagnose, treat, cure, or prevent any disease. Statements regarding our products have not been evaluated by the U.S. Food and Drug Administration unless expressly stated otherwise. Individual results vary. Before use, review the full ingredient list and, if you have sensitive skin, a known allergy, or a medical condition, perform a patch test and consult a physician or dermatologist prior to use. Discontinue use and seek medical attention if irritation occurs. Keep all products out of reach of children.

6. User Accounts & Credentials

If you create an account, you agree to:

  • Provide accurate, current, and complete information;

  • Maintain the confidentiality of your login credentials;

  • Notify us immediately at contact@meetfourleaf.com of any unauthorized use of your account or other breach of security.

You are responsible for all activity that occurs under your account. We are not liable for any loss arising from your failure to safeguard your account credentials.

7. User-Generated Content

If the Site allows you to submit reviews, comments, photos, or other content (“User Content”), you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, and display that User Content in connection with operating and promoting the Site and our products. You represent that you own or have the necessary rights to the User Content you submit and that it does not violate any third party’s rights or applicable law. We reserve the right to remove any User Content at our discretion.

8. Prohibited Conduct

When using the Site, you agree not to:

  • Violate any applicable local, state, national, or international law or regulation;

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) TONES DIGITAL LLC (DBA FOURLEAF) AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold harmless Tones Digital LLC (DBA FourLeaf) and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of these Terms; (b) your use of the Site; or (c) any User Content you submit.

13. Changes, Suspension & Termination

Tones Digital LLC (DBA FourLeaf) may modify, suspend, or discontinue the Site (or any part of it), with or without notice, for any reason, including suspected violations of these Terms. We may also update these Terms from time to time; the “Last Updated” date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. We are not liable for any consequences resulting from such changes, suspensions, or interruptions.

14. Force Majeure

We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disaster, labor disputes, supply chain disruption, war, terrorism, or governmental action.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.

15.2 Binding Arbitration & Class Action Waiver

Any dispute arising out of or relating in any way to these Terms or the Site will be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Los Angeles County, California, under its Consumer Arbitration Rules. YOU AND FOURLEAF EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

15.3 Opt-Out

You may opt out of this arbitration agreement by sending written notice to contact@meetfourleaf.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.

15.4 Small Claims

If your claim qualifies, you may instead pursue it in small claims court in lieu of arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Assignment & Waiver

We may assign these Terms, in whole or in part, at any time without notice. You may not assign these Terms without our prior written consent. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy, Shipping & Returns policy, and any other documents expressly incorporated by reference, constitute the entire agreement between you and FourLeaf regarding the Site and supersede all prior or contemporaneous agreements on this subject.
